Releasing
an Employee from a Non-Compete Agreement
The discharged employee may have previously signed
a Non-Compete Agreement, typically
during application for employment. This agreement is one in which the
employee agrees not to compete in any way with their employer during
the time of employment and for a period of time after employment.
Thus, this becomes a very restrictive agreement for terminated IT
employees seeking to find employment post-termination in the same
industry.
The employer may rescind this agreement as a
gesture of goodwill and ultimately self-interest. See Figure 6.2 for a
sample Non-Compete Agreement. This
agreement must be reviewed and approved by an attorney concerning all
possible legalities.
