Perform
Firing Policy Investigations in a Fair and Objective Manner
The firing policy investigation should be
comprehensive to determine all the facts surrounding the violation.
Attempt to find witnesses and conduct thorough interviews. Employees
must provide any known information related to a policy violation
investigation. The employer has the right to obtain such information
upon request in determining the facts of the matter.
Members of the IT staff who lie or refuse to give
information should be severely disciplined. You should also collect
facts through other methods such as surveillance cameras and physical evidence. Do not simply rely on hearsay.
Consider the circumstances of the events that
occurred. Were there other work or personal issues that drove the
employee to act as he or she did? Is it possible the employee was
framed by another devious employee? Who is telling the truth? Is the
evidence circumstantial? Was the employee’s performance affected
negatively by other uncontrollable factors? The IT manager needs to be
very careful that all such aspects of the investigation are
considered.
For policy violations that do not require
immediate dismissal, apply progressive disciplinebased on documented policies for behavior in a very structured and
consistent manner to any computer professional. For serious
violations, adhere to standard procedures for terminating employees.
Maintain a policy that all IT employees in similar situations are
treated fairly and equally without subjective alteration, doing so
will ensure a straightforward and objective process. This fairness and
objectivity will certainly be noticed by all employees, promote
positive acceptance, and ensure due process in a court of law if
necessary.
