Recovering a Stolen Identity

Check credit reports. Contact the creditors
that opened the fraudulent accounts and have them remove those
accounts from their record. This should be done in writing and
copies maintained.

Seek support from family members and/or close
friends. They may also want to speak to a counselor or victim
advocate. Besides being time consuming, dealing with identity theft
is emotionally exhausting.

Find out what their state’s identity theft laws
are and what their rights as a victim are.

Contact their local bar association or legal
aid office, especially if they have been left with a criminal record
due to the identity theft.
Legal Protection Against Identity Theft
July 15 2004 (Bloomberg) -- President George W.
Bush signed legislation increasing the punishment when fake
identification cards are used to commit crimes, including domestic
or international terrorist acts.
In addition to the Federal laws, there are laws
on the books in most states that make identity theft illegal. Even
where identity theft is not specifically named, there are usually
laws against the actions that are part of identity theft. For
example, North Carolina defines identity theft in §14-113.20-23 as:
