Chapter 8 -
Identity Theft
Financial identity fraud.
(a)A person who knowingly obtains, possesses,
or uses identifying information of another person, living or dead,
with the intent to fraudulently represent that the person is the
other person for the purposes of making financial or credit
transactions in the other person's name, to obtain anything of
value, benefit, or advantage, or for the purpose of avoiding legal
consequences is guilty of a felony.
The statute goes on to define identifying
information. This definition encompasses social security numbers
and credit card numbers, but also includes any other numbers or
information that can be used to access a person’s financial
resources.

Each state’s Attorney General is the person
responsible for enforcement of the state statutes. If the case
warrants, the U.S. Secret Service, the FBI, U.S. Postal Inspection
Service, and the Social Security Administration’s Office of the
Inspector General can investigate violations of federal law. These
cases would be prosecuted by the U.S. Department of Justice.
